I think it is down to the testers own opinion.

It shouldn't, it should only fail if it is a Reason for Rejection.

I used to be a Vehivle Examiner in the VI days before it changed to VOSA.

Failing on the merits of the testers opinion is WRONG and DOUBLE STANDARDS.

However, I personally would not USE a bike without a chain guard. It is there for a GOOD reason.

Maybe the testers manual needs updated to include this as a failure item??

The local mot guy is very anal .... so big plate, footrests, huge indicators blah blah, always get an advisory on the exhaust (GPz) always get picked up on chain wear (z650) though he hates tyre delaminating and has failed both bikes on that... he was happy to show me why... didn't get into an argument so I ordered a pair of tyres..
The place that mot'd it couldn't supply so I took the bike to "Guildford Tyres" and they did a great job except "the little rodent" tyre tech decided to measure my front disks and said it should failed on them and wanted me to tell them where the mot was done so he could ring them!
fortunately the guy who manages the place is a fellow bike rider and diver, so give him a bit of a slap ....
That was the day of the Yorkshire rally 2 years ago!

there are amendments to the testing manual in the form of special notices so dont presume that what is in the test manual is what is tested. some items are updated through these bulletins

Guyz,

At the end of the day the MOT is there to protect EVERYONE.

The rider, the pillion, other road users and the pedestrian.

The MOT tester is NOT the enemy.
He has a total shit job to do.

If he fails it the owner wants to cut his legs off.
If he passes it VOSA wants to cut his legs off.
If he passes it and the owner sells it, the new owner wants to cut his legs off.

I've told buddies that were going to start up MOT stations to WALK AWAY.

Chain guard is not there in case a chain snaps, it's there to prevent your appendages getting chewed.
Hence no passenger provision = no guard needed.
A snapping chain won't get diverted off its trajectory by a bit of tin or plastic.
I know this from first hand experience, a snapped 630 chain took out my bikes tail piece, rear light, engine cases and a big chunk of a girlfriends leg in its bid for freedom (It didn't touch the chrome guard)
The bike was a 750 hodna and the bird turned out to be a slag so no real harm done :D

I had a chain snap on a GS1000S on the M27 at 80mph, it disappeared into the sky at an incredible rate of knots after opening up my chrome chainguard like it had been attacked with a tin opener :shock:

Eventually it landed on this guy's bonnet and went up and over his roof leaving quite a few dents and scratches. He stopped and had a right go at me as if I had done it on purpose :roll: I just told him to "f*%k off" and he did :lol: never heard anything more about it. Had to push the bloody thing 7 miles home :(

My last mot I got failed on the flasher not flashing when on tickover :shock:

My interpretaion of a chain guard is to guard the chain from clothing, legs, shoes etc getting pulled in.

Did any of you see the programme about the girl going to her wedding on a TRIKE. Her dress got pulled into the prop shaft (not the same as our topic here, but very similar).

pre '86 can be a bit of a grey area for not having indicators fitted.
i'm fairly sure the official line is that if they were fitted from new then they should still be fitted to the bike, it was after 1986 that manufacturers had to fit indicators to new bikes by law.
having said that i did have the 'why have you no indicators' from a copper last year whilst on my z650....i told him it had never had any and being a 1977 bike that it didnt need them....he seemed happy enough with that, looked like he hadnt been born pre '86 anyway!
